SKEED.EU – General Terms and Conditions of Sale

Object

The general conditions of sale described below detail the rights and obligations of the company SKEED INTERNATIONAL SAS, with a capital of €145,868.00 whose registered office is at 24 rue Jean Baldassini, 69007 Lyon (RCS 81287713200025 Lyon) (Intra-Community VAT number FR95812877132) and its customer in the context of all sales concluded with consumers on the Skeed website.

Any service performed by the company Skeed INTERNATIONAL SAS implies unconditional acceptance of the buyer to these general conditions of sale.

The characteristics of the products offered for sale are presented on each "product description" on our website. The photographs do not enter the contractual field. The responsibility of the company SKEED INTERNATIONAL SAS cannot be committed if errors occur. All texts and images presented on the website of the company SKEED INTERNATIONAL SAS are reserved, for the entire world, under copyright and intellectual property rights; their reproduction, even partial, is strictly forbidden.

Prices

The prices of the products sold are those in force on the date of the order. They are expressed in Euros and include all taxes but exclude shipping costs. Consequently, they will be increased by the rate of VAT and transportation costs applicable on the date of the order. 

The company SKEED INTERNATIONAL SAS grants the right to change its prices at any time. However, it undertakes to invoice the goods ordered at the price indicated upon placement of the order.

Order

The Customer confirms his/her order when he/she activates the link "Confirm your order" at the bottom of the page "Order summary". Validating this order binds the customer to accept these general conditions of sale. Before confirmation, it automatically offers the customer the option to check each of the items in the order; he/she may then correct any errors.

The company SKEED INTERNATIONAL SAS confirms the order by email; this information includes the items in the order and the customer's right of withdrawal.

The data recorded by the company SKEED INTERNATIONAL SAS constitute proof of the nature, content and date of the order. This is then filed by the company SKEED INTERNATIONAL SAS under the legal conditions and deadlines; the customer may access this file by contacting the Customer Service department.

Retention of ownership

The company SKEED INTERNATIONAL SAS retains ownership of the products sold until payment is made, including the principal and ancillary costs. To that end, if the purchaser is subjected to statutory reorganisation or is liquidated by court order, the company SKEED INTERNATIONAL SAS reserves the right, as part of the collections procedure, to claim merchandise which has been sold but not yet been paid for.

Delivery

Delivery is made by: 

  • By sending the goods to the buyer's home address;
  • Or to the place specified by the buyer upon order;
  • By sending the goods to the nearest "Point Relais" to the buyer's home [in France];

The delivery period indicated when the order is placed is indicative only and is not guaranteed.

Consequently, any reasonable delay in delivery of the products will not allow the buyer: 

  • The allocation of damages and interests;
  • To cancel the order.

The risk posed by transport is borne by the buyer. 

In case of missing or damaged goods during transport, the buyer will have to make all the necessary reserves with the transporter upon receiving the goods, and to inform the company SKEED INTERNATIONAL SAS of any inconvenience encountered. 

Defective items

If you have any problems with your new SKeeD product or if you think it is defective, please call Customer Service immediately to report it. Do not forget that SKEED INTERNATIONAL SAS must be notified of any damaged product before the 14-day period of withdrawal. It is essential that the parcel is checked upon delivery; it may be refused if it displays visible dents. We may only replace an article by the same article that you ordered and it is your responsibility to return the article to us.

Method of withdrawal

You have a period of withdrawal of 14 days from the day of receipt to return your product to us. You must contact our customer service in order to receive a return number. This option falls under your rights as a consumer to return defective products to us. The products must be sent back in their original state (label) and in their original packaging. 

In case of withdrawal, SKEED INTERNATIONAL SAS will reimburse you with the amount of your order excluding shipping costs. The company may defer the reimbursement until the products are recovered or until you have provided proof of sending the products.  

Force majeure

The liability of the company SKEED INTERNATIONAL SAS cannot be implemented if the non-compliance or delay in the execution of one of its obligations described in these general conditions of sale arises from an event of force majeure. In that respect, force majeure refers to any unforeseeable or unstoppable outside event in the sense of article 1148 of the French Civil Code.

Court of competent jurisdiction

Any dispute concerning the interpretation and execution of these general conditions of sale is subject to French law.

Failing amicable resolution, the dispute will be brought before the Commercial Court of Lyon.
